ปัญหาการนับระยะเวลาสำหรับการชำระหนี้ของผู้ค้ำประกัน : กรณีศึกษามาตรา 691 ประมวลกฎหมายแพงและพาณิชย์

Abstract


This research aims to (1) analyze section 691 of Civil and Commercial code (CCC) relating to repayment period by guarantor after debtor and debtee reaching debt restructuring decision (2) assess effects of problem to guarantor and debtor processing by content analysis. The results showed that (1) repayment period brought into effect when informing guarantor by a document. The interpretation of “informing” basing on 3 theories which are doctrine of dispatch, doctrine ofreception, and doctrine of perception. (2) either doctrine of informing brought different effects to debtor and debtee describing as followed (2.1) “informing” under the doctrine of dispatch affected the period of repayment by reducing the actual time in section 691 of CCC so that debtor can receive the payment sooner. (2.2) “informing” under the doctrine of reception affected the period of repayment by extending the time appropriately stating on section 691 of CCC. (2.3) informing under the doctrine of perception affected the period of repayment by extending the time of repayment when guarantor de facto recognized messages contain in document. Therefore, debtor tended to receive late payment.
